Most supervisors and managers can't sack a subordinate without first getting the approval of management and Human resources. The purpose of this article is not to pitch you on my lay off manual and proprietary procedures, but to give you some real help with dismissals whether you decide to get my manual or not. This is frequently someone whom the gross misconduct harmed. Now, you decide you have had enough and are ready to separate the women. Most juries find it insensitive to fire an employee while she's away on family leave, medical leave and disability. When a worker is violent, caught stealing from the business or threatens the safety of other coworkers, you have a cut-and-dry case for separation. The only exceptions are if the worker has stopped showing up for work or if the worker is in a circumstance where the boss can't speak with them in person. When you feel comfortable with the consequences, go ahead and dismiss the bad individual. This includes you as the layoff supervisor, the laid off jobholder, his family and the coworkers left behind. This is one of the hardest steps for employers to take in dealing with a difficult individual. You should not get emotionally involved with the difficult behavior.

You have advised your employees of the rules, you have given repeated verbal warnings, and at times problem behavior continues after a written notification. Of course, any jail time should be unpaid and you should take it out of their leave time. Regardless of whom is in charge of supervising the employee, everyone responsible should be aware of proper evidence procedures. Step 1-Before you even sit down the worker to begin the verbal termination process, you should prepare an employee separation notice notification that officially tells them you have terminated them.
